On October 1, 1988, the National Childhood Vaccine Injury Act of 1986 (Public Law 99-660) created the National Vaccine Injury Compensation Program (VICP).
The VICP was established to ensure an adequate supply of vaccines, stabilize vaccine costs, and establish and maintain an accessible and efficient forum for individuals found to be injured by certain vaccines. The VICP is a no-fault alternative to the traditional tort system for resolving vaccine injury claims that provides compensation to people found to be injured by certain vaccines. The U. S. Court of Federal Claims decides who will be paid.
Three Federal government offices have a role in the VICP: 1) the U.S. Department of Health and Human Services (HHS); 2) the U.S. Department of Justice (DOJ); and 3) the U.S. Court of Federal Claims (the Court). The VICP is designed austensibly to protect the public; however, more than compensating the injured, the VICP protects the vaccine manufacturers from liability and lawsuits. |

The Smallpox Emergency Personnel Protection Act of 2003, Public Law 108-20, 117 Stat. 638, authorized the Secretary of Health and Human Services to establish the Smallpox Vaccine Injury Compensation Program. The program was appropriated $42 million to provide benefits and/or compensation to eligible individuals. HHS Secretary Tommy G. Thompson announced an interim final rule that described eligibility criteria and the process for requesting benefits on December 16, 2003. |

Preparedness Countermeasures Injury Compensation may compensate individuals for serious physical injuries or deaths as a result of a pandemic, epidemic, or security countermeasures, such as a vaccine.
Only countermeasures specifically identified in declarations by the Secretary, U.S. Department of Health and Human Services are eligible for compensation benefits, which may include out-of-pocket medical expenses, lost employment income and/or survivor death benefits.
Currently, only individuals who received the pandemic influenza A (H5N1) vaccine on or after December 1, 2006 through February 28, 2010 are eligible to request compensation.
Individuals have one (1) year from the date the vaccine or other covered countermeasure was administered to request compensation benefits. |
